User agreement
- This agreement is intended to regulate the relationship between the user and the copyright holder of the internet portal ba-za.gg
- Baza project, hereinafter referred to as the “administration,” invites you, hereinafter referred to as the “users,” to familiarize yourself with the rules of the game and project.
1. General Provisions
1.1 Game Website – https://ba-za.gg/
1.2 Operator – the copyright holder of the ba-za.gg portal, who is a party to the user agreement. The Operator manages and maintains the portal, providing users with access to the portal and services (including paid services) under the terms of this agreement.
1.3 User – an individual visiting the portal or participating in the portal's projects.
1.4 Portal – special software and hardware complexes located on the Operator’s resources. User access to the portal is provided solely by the Operator. All rights to use this portal belong exclusively to the Operator.
1.5 Services – providing users with access to the portal, use of features and services, and participation in projects under terms specified in agreements. Operator services are provided free of charge, except for additional paid services. All services are provided by the Operator only within the portal, i.e., during its use by the user.
1.6 To ensure technological access to the game process, the user utilizes baza.exe – auxiliary software (including built-in technical protection measures), which is necessary to download/update the game client to meet the technical parameters of the game process.
1.7 Additional Paid Services – providing the user with additional special portal features for a fee. These services are optional and provided at the user's request. Paid services are also provided by the Operator solely within the portal.
1.8 Game accounts, characters, and items are the property of the project and do not constitute personal property rights.
1.9 Access to the game process is possible only through baza.exe.
2. Subject of the Rules
2.1 This document establishes the rules that must be strictly followed for the user to be entitled to use the services for participation in the game process.
2.2 According to the terms of these rules, the administration provides the user with the opportunity to use the game 24/7, except during maintenance work or in the event of other circumstances preventing access to the game.
3. Additional Conditions
3.1 To properly use the services, the user must meet the minimum system and technical requirements.
3.2 The administration does not refund game assets lost due to the user losing access to their account. However, the administration may, at its discretion, restore game assets lost due to errors, malfunctions, hacking, or other software failures.
3.3 The administration is not responsible for the loss of game assets due to failure to update the game client through the updater. Players are required to launch the game via the updater to avoid errors.
3.4 The administration does not exchange game assets for real money.
4. User Rights and Obligations
4.1 During registration, the user selects a nickname, login, and password, which will identify them among other service users. The user must provide the administration with accurate registration data.
4.2 With the administration's permission, the user may change their password. The user is responsible for keeping their password and other necessary information confidential and bears responsibility for disclosing this data, along with any associated risks (losses).
4.3 The user may not “resell” services provided by the administration to third parties or derive any other benefit from them.
4.4 The user may not distribute information aimed at unlawfully obtaining access passwords to game characters or share links to sites with such information.
4.5 The user must treat other users and the game administration with respect and courtesy. Specifically:
- Do not use profanity in public game chats and forums.
- Do not threaten violence or physical harm.
- Do not distribute materials that promote or express hatred toward any religion, culture, race, nation, people, language, politics, ideology, or social movement.
- Do not advertise pornography, drugs, or related content, and do not distribute materials featuring minors in a pornographic context or encourage minors to participate in such activities. Do not post information about developing or using drugs or methods of suicide, or incite suicide.
4.6 The user may not spread false information (rumors, slander) about the game service, administration, staff, or other users. It is forbidden to use terms in names that imply administrative functions or impersonate a representative of the administration.
4.7 When using chat services in the game, users may not repeatedly send the same text. Messages must have at least a one-minute interval, except for trading messages in the trade chat.
4.8 Users may not restrict others' access to the game or interfere with others' gameplay. Climbing textures (rocks, elevations, etc.) accessible only via Wyvern is prohibited. Players may not obstruct gameplay mechanics or cause critical errors for other players.
4.9 Users must not transmit information or software containing viruses or harmful components, or engage in actions that violate applicable law or international regulations.
4.10 Posting advertisements on administration resources is prohibited.
4.11 Users may not use game assets or advantages obtained through rule violations by third parties.
4.12 Disclosing confidential or false information about another user is prohibited.
4.13 Selling, buying, exchanging, transferring, or receiving game items or account access for non-game currency or means not provided for in the project is prohibited. Transactions between servers or games are forbidden, as is discussing such transactions. Attempting to transfer deals to external chats (VK, Skype, Discord, etc.) is prohibited.
4.14 Inciting or provoking players to engage in RMT (real money trading) within the project or on third-party platforms (VK, Twitch, YouTube, etc.) is forbidden.
4.15 Using offensive language or inappropriate titles for characters, pets, clans, and alliances is prohibited.
4.16 Transferring accounts to third parties or using others' accounts is forbidden. Users bear full responsibility for account and item security. If an account is shared or accessed by someone who violates project rules, both parties may be blocked.
4.17 Selling accounts, even for game currency, is forbidden. Transferring accounts or characters as gifts is also prohibited.
4.18 Using software or devices to simulate player presence (e.g., using objects to hold down keys, external software, or other tricks) is forbidden. Players must fully control gameplay and respond to Game Masters' checks.
4.19 Software disrupting server software or interfering with data exchange between server and client is prohibited.
4.20 Hacking or attempting to hack, intercept data, or bypass administrative restrictions (e.g., window limits, HWID blocking) is forbidden.
4.21 Exploiting server bugs, including geographical data issues, is prohibited. Using hard-to-reach textures for farming or exploiting similar features to deceive players is forbidden. Users must report server bugs to the administration.
4.22 Users may be rewarded for timely reporting game issues to the administration.
4.23 Users must not hide information about players exploiting server bugs or violating server rules.
4.24 Using non-standard fonts in the technical support section of the forum is prohibited.
4.25 Announcing your departure or encouraging others to leave the server is forbidden.
4.26 Selling clans/alliances or castles, even for game currency, is forbidden.
4.27 Organizing games of chance, lotteries, or similar activities for profit is prohibited.
4.28 Accessing third-party accounts, transferring game assets from third-party characters, or facilitating such transfers is forbidden. Scamming or defrauding players, including password theft or trickery, is prohibited. Restoration of stolen assets is not guaranteed.
4.29 Theft, fraud, or abusing players’ trust for personal gain is forbidden.
4.30 Deceiving players and engaging in fraudulent activities is prohibited, except for pre-arranged duels in the Olympics and agreed-upon leveling arrangements. The administration will not interfere in such agreements unless abuse occurs.
4.31 Users must use strong passwords and HWID binding. The user is responsible for account security. The administration may refuse to restore assets if an unsecured account is compromised.
4.32 Farming PvP/PK points or throwing matches in 3v3 fights is forbidden. Abusing PvP/PK mechanics for ratings is prohibited. Quest completion and daily tasks are exceptions.
4.33 Manipulating automated rewards (e.g., online timers, voting rewards) is forbidden. Receiving rewards on multiple HWIDs is considered abuse.
4.34 Selling non-game items in chat is prohibited.
4.35 User rights and obligations extend to the game, website, forum, and official social media pages.
4.36 Spamming other players with trade, group invites, or friend requests to disrupt gameplay is forbidden.
4.37 Posting messages about selling game items or recruiting for clans or groups that do not relate to the current server is forbidden.
4.38 Using the "Search" chat tab or the "Group Search" action improperly is prohibited. Only group recruitment messages are allowed.
5. Operator Rights
5.1 This Agreement grants the Operator the following rights:
- Unilaterally modify, expand, or limit services or paid services without prior notice.
- Manage portal processes at its discretion.
- Suspend or change processes without prior notice.
- Apply sanctions for rule violations.
- Delete or modify user information on the portal.
- Monitor and retain user identification and statistical data.
- Notify users of rule violations. All Operator instructions must be followed.
- Take legal action to protect intellectual property.
- Modify the portal without prior notice.
- Inaction on rule violations does not waive future sanctions.
- Deny rewards for events, tournaments, or promotions without explanation.
5.2 The Operator, as a party to the user agreement, is obligated to:
- Ensure users can access services within the portal, including paid services.
- Respond to user inquiries and resolve disputes as needed.
5.3 The Operator is not liable for:
- Damage to user data or computers caused by portal use.
- Losses from portal unavailability or unauthorized data access.
- User statements or unlawful actions on or outside the portal.
- Registration information errors or lost portal access.
- Lost virtual assets due to service provision.
- Payment-related expenses for additional paid services.
- Portal uptime or internet access and data speed issues.
5.4 The Operator does not guarantee:
- Uninterrupted or error-free service.
- Satisfaction of user expectations.
- Evidence for rule violations or imposed sanctions.
- Users access the portal at their own risk and understand potential risks.
6. Confidentiality and Security
6.1 Confidential information includes data collected during user registration and portal use.
6.2 Confidential information will not be disclosed to third parties.
6.3 Personal data may be disclosed only:
- To law enforcement upon official request.
- With the user’s consent.
- When services cannot be provided (users will be notified).
- For rule violations (at the Operator’s discretion).
6.4 The Operator ensures data security using specialized software. Data safety is not guaranteed in case of unauthorized access.
7. Additional Paid Services
7.1 At the user's request, the Operator provides additional paid services, expanding portal functionality.
7.2 Paid services are optional.
7.3 Once funds are debited, the service is considered fully rendered.
7.4 Payment for services is non-refundable.
7.5 The user agrees that the Operator may store information collected during service purchase.
7.6 Paid services and their prices are listed only on the portal. Offers on third-party sites are considered fraudulent.
7.7 Payment options are explained on the website.
7.8 The Operator is not responsible for payment system operations.
7.9 Users must report unpaid services and settle debts.
7.10 The Operator does not refund unused paid services.
7.11 Users bear all financial costs for services, including fees and commissions.
7.12 Users confirm their legal right to enter agreements for paid services.
7.13 Minors must obtain consent from legal representatives before purchasing services.
7.14 Responsibility for service purchases lies with the user and their legal representatives.
7.15 Disputes over service purchases with the Operator are prohibited.
7.16 Services are provided only after full payment.
7.17 Refund requests must be emailed to [email protected] with payment details.
8. User Agreement Appendices
8.1 Tactical obstacles in clan battles are allowed if permitted by game mechanics.
8.2 Entering castles must be done through gates and walls.
9. Disclaimer of Warranties
9.1 Services are provided “as is.” No warranty is given for services or virtual assets.
9.2 Excessive PC use, including gaming, may harm health. Users must monitor their health and restrict service use as needed.
9.3 The Operator is not liable for indirect losses, including fraud or negligence by third parties.
10. Additional Provisions
10.1 Users must comply with local laws. Users are responsible for portal use in their country.
10.2 Invalid clauses do not nullify the agreement. Obligations must still be met.
10.3 Disputes are settled out of court or according to Russian law.
10.4 The Operator may amend the agreement without notice. Users must review changes.
11. Agreement Terms
11.1 Registration is done through the Operator’s resources. Users must read the agreement and rules.
11.2 Registering or using the game constitutes agreement acceptance under Russian law.
11.3 The person logged in is considered the account owner unless proven otherwise.
